What is a T Visa?
A T visa is a form of protection under U.S. immigration law. It exists to help people who were forced, tricked, or pressured into work or sex they could not refuse.
It allows people who were trafficked to remain in the U.S. for up to four years. During this time, they can get a work permit, access some federal and state benefits, and even eventually apply to become permanent residents. The T visa can also protect family members of the trafficking victim.
Natalia Darancou Law, PLLC, helps people like you understand the T visa requirements and T visa processing time and apply them correctly.
What Are the T-Visa Requirements?
To get a T visa, someone must have experienced a severe form of trafficking. This includes two main types:
- Sex trafficking: When a person is forced, tricked, or pressured into commercial sex acts or is under 18 and exploited.
- Labor trafficking: This is when someone is made to work even though they don’t want to. They’re forced into working through tricks, threats, or lies. The victims are stuck working without a choice or having debts that they can’t get out of.
To qualify for a T visa, an individual must be physically present in the United States on account of having experienced human trafficking and must show that they would face extreme hardship involving unusual and severe harm if required to leave the country.
A person may qualify for a T visa even if they entered the United States for another reason, as long as they later became a victim of human trafficking in the U.S. and meet the other eligibility requirements. Sometimes, victims must help law enforcement investigate or prosecute traffickers. But if the person was under 18 at the time, or is too traumatized, this step may not be required.
How to Apply for a T Visa
Step 1: Fill Out Form I-914
To begin, you must fill out and submit form I-914. You have to tell your story, explaining what happened. You also have to bring proof, such as police reports, medical papers, or someone writing a statement that says they saw what happened.
If available, you may also submit Supplement B, a law enforcement certification confirming your cooperation. While not required in every case, it can strengthen your application.
Step 2: Attend the Interview
Some applicants may be required to attend an interview at an embassy or consulate, where documents, photographs, and fingerprints are collected. While not required in every case, it is important to be prepared.
Step 3: T Visa Processing Time
No one can really tell you exactly how long a T visa will take. USCIS has tons of applications to go through. Some are more complicated than others. Some people wait a few months; some people wait up to a couple of years.
There’s a website where you can check how long the current T visa processing time is and get progress reports for your case: USCIS processing times. Working closely with a T visa lawyer can help ensure all required information is properly documented and submitted, reducing delays caused by incomplete or inaccurate filings.
Step 4: After Approval
If you get approved, that means you can work in the U.S. and start living normally. After a few years, you can apply for permanent residence; also known as a green card. And you can start planning your future in the U.S.
It’s important not to travel outside of the U.S. without guidance, because leaving can affect your status.
